
IN PENNSYLVANIA We recommend that Pennsylvania clients purchase Full Tort liability auto insurance instead of Limited Tort insurance. If you do not know what kind of insurance you have, you should ask your agent what Tort you have elected. If you elected Limited Tort and if you are injured in an accident, you may not suit for damages unless you are seriously injured.
For New Jersey clients, we recommend that you purchase No Limitation on Lawsuit/No Threshold auto insurance. When you are involved in an accident and if you are subject to the Limitation on Lawsuite/Lawuit Threshold, you must establish that you have sustained one of the following injuries before you can claim damages for non-economic loss: 1) death 2) dismemberment (loss of arms, legs, fingers, or toes) 3) significant disfigurement or significant scarring 4) displaced fracture (broken bone) 5) loss of a fetus (unborn child) 6) permanent injury within a reasonable degree of medical probability, other than scarring or disfigurement. An injury shall be considered permanent when the body part or organ, or both, has not healed to function normally and will not heal to function normally with further medical treatment. |
